The bill aims to hold funeral homes and crematories more accountable when it comes to the responsibility of handling a decedentʼs remains in the state of Illinois. There are two overarching moral goals with this new act: Prevent the misidentification of dead bodies or human remains.

The legal next of kin must sign a Cremation Authorization Form. Once the cremation is correctly authorized, the funeral director can obtain the permit. Illinois has a mandatory legal waiting period of 24 hours before the actual cremation can occur.

This right and responsibility goes to the following people, in order: a person you name in your will, prepaid funeral or burial contract, health care power of attorney, cremation authorization form, or other form that satisfies the requirements of Illinois law. the executor or legal representative of your estate.
